I understand that participating in baseball training, biomechanical assessments, and related physical activities at BioPrecision LLC involves risks including muscle strains and sprains, impact injuries from equipment or drills, joint injuries, worsening of pre-existing conditions, and slips, trips, or falls. I voluntarily assume all risks associated with participation.
I hereby voluntarily release and discharge BioPrecision LLC and the WVU Baseball Biomechanics and Performance Center, its owners, staff, contractors, agents, affiliates, and successors from any and all liability, claims, demands, or causes of action arising from participation. This release applies to claims based on ordinary negligence but does not waive claims for gross negligence or intentional misconduct, per West Virginia law.
I affirm that I am in good physical condition and have no known medical conditions that would prevent safe participation. I authorize WVU Baseball Biomechanics and Performance Center to provide or seek emergency medical care on my behalf if needed. I assume responsibility for any related medical costs.
I grant BioPrecision LLC the perpetual, unrestricted, and royalty-free right to collect, store, analyze, and use my biomechanical data, motion capture data, video, and audio recordings for internal analysis, product development, research, commercial use, marketing, social media, and public presentations. I waive any right to inspect, approve, or be compensated for such use and understand this consent is irrevocable.
I understand that photos or videos taken during sessions may be used publicly. If I do not want my identifiable media used for marketing or social media, I must check the opt-out box below.
If any portion of this agreement is found invalid or unenforceable, the remaining sections shall remain in full force and effect.
